Terms of Service

These Terms govern your use of Notdown — an uptime, cron heartbeat, domain expiry, and SSL monitoring service operated by Martin Macháček, a sole trader based in the Czech Republic ("we", "us"). Notdown is built for developers.

By creating an account, calling our API, connecting via MCP, or using the CLI, you agree to these Terms. If you don't agree, don't use the service. The phrasing is kept plain on purpose; every clause is binding.

1. The service

Notdown monitors HTTP endpoints, cron heartbeats, domain expiry (via RDAP), and TLS certificates. Alerts go to email, Telegram, Slack, Discord, or any webhook you configure. You can operate the service from the web dashboard, the REST API, the CLI, or any MCP-compatible AI agent.

2. Accounts

  • You must be at least 16 years old.
  • Give us a real email and keep it current — that's how alerts and account notices reach you.
  • Your password and API tokens are yours to protect. Anything done with them counts as done by you.
  • One person or legal entity per account. Don't open multiple accounts to dodge limits.

3. Acceptable use

Don't use Notdown to:

  • Monitor systems you don't own or have permission to test.
  • Run load tests or denial-of-service attacks. Notdown is a monitor, not a load generator — check intervals are bounded server-side to keep total request volume reasonable.
  • Probe or scan our own infrastructure without written permission.
  • Reverse engineer the service, except where mandatory local law says you may.
  • Resell, white-label, or sublicense Notdown without a written agreement.
  • Send spam, phishing, or unlawful content via your configured webhook channels.
  • Upload or store anything that is illegal or violates third-party rights.

Accounts that break this section may be suspended or terminated at our discretion.

4. Pricing

Notdown is currently free, with no paid plans and no credit card on file. When paid plans launch, this section will be updated and pricing will appear on the site before any charge. Until then, every feature is free.

5. Fair use

Check intervals and monitor counts are bounded server-side. If an integration goes haywire — runaway loops, broken webhook bodies, infinite retries — we may throttle or temporarily disable it at any time without prior notice.

6. Your content

You own everything you put into Notdown — URLs, schedules, webhook endpoints, names, configuration. You grant us a limited license to process it for the sole purpose of running the service for you, as described in our Privacy Policy. You can export or delete it any time.

7. Service availability

We aim for high availability but make no uptime guarantee, and we offer no SLA. Notdown is provided "as is" and "as available", and may be unavailable at any time for any reason without notice.

8. Third-party services

Notdown relies on Laravel Cloud, Cloudflare, Resend, RDAP registries, and the webhook endpoints you configure yourself. We're not responsible for their outages, content, or behavior. Their terms apply to your interaction with them.

9. Intellectual property

The Notdown name, logo, dashboard, design system ("Heartbeat"), source code, and documentation are owned by Martin Macháček. Don't copy, modify, or redistribute them except where mandatory local law allows or we've given written permission.

10. Disclaimer

To the maximum extent allowed by law, Notdown disclaims all warranties, express or implied — merchantability, fitness for a particular purpose, non-infringement. We don't warrant that alerts will be delivered in real time, that every up/down classification is correct, or that the service is free from bugs. Monitoring is best effort. Don't use Notdown as the sole indicator for safety-critical systems.

11. Limitation of liability

To the maximum extent allowed by law, our total liability to you for any claim related to the service is capped at the amount you've paid us in the 12 months before the event giving rise to the claim. While Notdown is free, that cap is €0. We're not liable for indirect, incidental, special, consequential, or punitive damages — including lost revenue, lost data, business interruption, or downtime of your own systems. These limits don't apply where excluded by mandatory consumer-protection law.

12. Indemnification

You agree to indemnify Notdown and its sub-processors against any claim arising from your violation of these Terms or your misuse of the service — including monitoring systems without authorization.

13. Termination

You can delete your account any time from the settings page. We may terminate or suspend access at any time, with or without notice. On termination, access stops and data is removed per the schedule in the Privacy Policy.

14. Governing law

These Terms are governed by the laws of the Czech Republic. Disputes go to the competent Czech courts. EU consumers keep the right to bring claims in their own member state and to mandatory local consumer-protection rights.

15. Changes

The current version of these Terms always lives at this URL. Continued use after a change counts as acceptance.
