Terms of Service

These Terms of Service ("Terms") govern your access to and use of Notdown, an uptime, cron, domain expiry, and SSL certificate monitoring service ("Service"). The Service is operated by Martin Macháček, a sole trader based in the Czech Republic ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Notdown lets you monitor the availability of HTTP endpoints, schedule heartbeat-based cron checks, watch domain registration expiry via RDAP, and watch TLS certificate validity and expiry. Alerts are delivered by email and optionally to Slack or Discord channels you configure.

2. Eligibility & accounts

  • You must be at least 16 years old.
  • You must provide accurate registration information and keep it current.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • You may not transfer or share your account credentials.
  • One natural or legal person per account. Multiple accounts to circumvent plan limits are prohibited.

3. Acceptable use

When using the Service, you agree not to:

  • Monitor systems you do not own or for which you do not have the owner's permission to test.
  • Use the Service to launch denial-of-service or load-testing attacks. Notdown is a monitor, not a load generator. Configured check intervals are bounded per plan to keep total request volume reasonable.
  • Probe, scan, or test the vulnerability of the Service or its infrastructure without prior written consent.
  • Reverse engineer, decompile, or attempt to extract source code, except as permitted by mandatory local law.
  • Resell, white-label, or sublicense the Service without a written reseller agreement.
  • Use the Service to send spam, phishing content, or other unlawful messages via Slack or Discord webhooks.
  • Upload or store content that is unlawful, infringes intellectual property, or violates third-party rights.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

4. Plans, billing & refunds

  • Plans, prices, and feature limits are listed on the Notdown website and shown to you before checkout.
  • Paid plans are billed monthly or annually in advance through Stripe.
  • We may change prices for future billing periods with at least 30 days' email notice. Your current billing period is unaffected.
  • 30-day money-back guarantee: if Notdown does not work for you, request a full refund within 30 days of your first paid charge by emailing support@notdown.dev. After 30 days, paid periods are non-refundable.
  • You can cancel any time from the billing page. Cancellation takes effect at the end of the current billing period.
  • Failed payments: we retry. After 14 days of failed payment, your account downgrades to Free.

5. Plan limits & fair use

Each plan ships with a maximum number of monitors and a minimum check interval. Adding a monitor or shortening an interval beyond your plan limit requires an upgrade. We reserve the right to throttle or temporarily disable accounts that abuse the Service in a way that affects other users (e.g. high-volume malformed requests, runaway integrations). We will contact you before taking action, unless the abuse is causing immediate harm.

6. Your content

You retain ownership of all data you submit (URLs, configuration, webhook URLs, names). You grant Notdown a limited license to process this data solely to operate the Service for you, as described in our Privacy Policy. You can export or delete your data at any time.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may schedule maintenance windows; we will announce them in advance when practical. Notdown is provided "as is" and "as available". No SLA is offered for Free or Solo plans. Pro plan customers receive priority email support with best-effort response targets shown alongside each paid plan.

8. Third-party services

Notdown depends on third-party services (Stripe, Resend, Hetzner Cloud, Cloudflare, Sentry, RDAP registries, your configured Slack/Discord webhook endpoints). We are not responsible for outages, content, or behavior of these third parties. Their terms apply to your interaction with them.

9. Intellectual property

The Notdown name, logo, dashboard interface, design system ("Heartbeat"), source code, and documentation are owned by Martin Macháček. You may not copy, modify, or redistribute them except as permitted by mandatory local law or with written permission.

10. Disclaimer of warranties

To the maximum extent permitted by law, Notdown disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Notdown does not warrant that alerts will be delivered in real time, that monitored systems are correctly classified as up or down, or that the Service is free from errors. Monitoring is best effort. Do not rely on Notdown as the sole indicator for safety-critical systems.

11. Limitation of liability

To the maximum extent permitted by law, the total liability of Notdown to you for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. Notdown is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost data, business interruption, or downtime of your own systems. These limits do not apply where excluded by mandatory consumer-protection or other law.

12. Indemnification

You agree to indemnify and hold harmless Notdown, its operator, and its sub-processors from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service, including monitoring of systems without authorization.

13. Termination

You may terminate your account at any time from the settings page. We may terminate or suspend access at any time for material breach of these Terms, with notice when practical. On termination, your access stops; data is deleted in accordance with the retention schedule in the Privacy Policy.

14. Governing law & jurisdiction

These Terms are governed by the laws of the Czech Republic. Disputes will be resolved by the competent courts of the Czech Republic. EU consumers retain the right to bring claims in the courts of their member state and to mandatory consumer-protection rights provided by local law.

15. Changes

We may update these Terms from time to time. Material changes are announced by email at least 30 days before they take effect. Continued use after that period constitutes acceptance.
